Dealer sold vehicle with active recall?

Just bought an XLT ER from Ford dealer. I've had it two days and it threw the HVB fault telling me to pull over. (Of course the happens Friday evening during heavy traffic.)

I had it towed to the nearest Ford dealer (but not where I bought it.)
I come to find out it has two mfr recalls pending. My VIN is 53xxx.

What are the chances this is an easy (software) fix and won't have my two day old truck at the dealership for a month waiting on parts?

Second question is that I was reading that it is against the law to sell a new vehicle with open recalls. What kind of recourse should I seek if it's sitting at dealer for an extended period?

Unfortunately they might not have run the diagnostic on the HVB after flashing the new BECM software, they "Should have seen a potential issue then.

Second question is that I was reading that it is against the law to sell a new vehicle with open recalls. What kind of recourse should I seek if it's sitting at dealer for an extended period?
Technically it's a CSP not a recall, though ford had requested all in stock trucks have the software remedy applied and HVB diagnosis checked before sale.

Get ahold of the Ford BEV team for an approved loaner vehicle, if a battery module needs to be pulled, it could take anywhere from [less than a week to several weeks] pending parts and the tech's availability where your truck is currently parked for service

You should be able to see the CSP's listed in your Ford Pass under the Service tab > Customer Service Program.

Also actual recalls have their own tile under Service tab, mine is hidden at the moment since my last recall was for the tailgate light and wiper motor replacements, previously done.

Thanks for the info. I guess I'll find out sometime next week. It's at a large dealership service dept and hopefully has more expertise than the rural dealership that I bought the truck from.

Sorry to hear about that. Hopefully it is fixed soon and you'll have a chance to love the truck.

Not sure what app you were using there but as @TaxmanHog pointed out, those were not recalls but Customer Satisfaction Programs. So not subject to a stop sale. Also the BECM CSP is sometimes not cleared by the dealer after the software update is applied because it could still throw a fault (like yours did).

What part of TX are you in? There is one dealer in the DFW metro that has done well with a few of these compared to many stories we hear.

I think these are CSP's and not recalls! I bought my truck with an active recall (blower may not produce heated air - this was a safety recall) dealer couldn't deliver the truck to me until this was completed, took about 10 days to get part and do the work, gave me a gas loaner. My truck is going in to have the battery monitor sensor replaced next week, going to get them to update all the SYNC and Ford Power Up Software to latest revisions when in then, you might want to ask your dealer to do this too as the OTA updates are a lottery from what I can tell. Hopefully you get your truck fix asap and back on the road.

Its at a large Houston area Ford dealer. And yes I sent it there hoping that they will know how to diagnose and repair quickly. The rural dealer where I bought it at has only sold a handful of Lightnings. The trade off is that the HOU dealer is much busier and who knows how long until they can get to it.

Yeah. What's weird is that the truck threw the fault right after getting update 4.2.1.1. I dunno if that's related. I don't currently have a loaner as I dropped it off 15 minutes before close on Friday evening. I guess if it ends up being a bad cell, I'll be asking for one though.
