Can the dealer refuse to sell ?

I received the invite on the first wave. I did not have a relationship with the dealer because I had recently moved to the area and just picked the closest dealer when I made my reservation within the first few minutes on May 19. The dealer called and said I was #1 and asked if I was going to order online. It took me a few days to decide because I had planed on ordering the XLT ER, but the price shocked me a bit, also I was reading all this stuff about ADM. Finally 6 days later I went online and ordered the Lariat ER, The next morning I called the dealer to alert him that I had ordered, he immediately accepted my order at MSRP. I asked if I needed to do anything else, he said no, so I left it at that.

MY QUESTION: Is there any way that this dealer can get out of selling me the truck if I show up and pay for it when it is delivered?

No, he can't. Your order+deposit is a contract to sell to you when it arrives. You can choose not to accept, but you have the first right of refusal on it.

Sadly I believe the answer is yes. In the current model the dealers have all the power. Would a dealer choose to do it? I hope not but that is why I shopped around for a dealer I felt I could trust and was selling at a fair price.

The dealer can always try to screw you when your order is delivered and you go into do final paperwork. They can say "OH, by the way we have a $5,000 dealer fee" -pretty much ADM, or other b.s. fee's. Of course you'd either have to pay it or walk away and they get truck.

So if i were you, go into the dealer and fill out a buyers order with all the fees, plates, tax written down. That way your price is pretty much locked in.

You you received two polar opposite responses, I’ll be the tie-breaker. I agree with post #2. Just get your order in writing!

To be a second tie-breaker.... Assuming you have a good grasp on the dealer, then I see no reason to go out of your way to get something in writing. I choose my dealer because they were known as an MSRP dealer from Mach-e forums and specifically said no markup... Additionally, on your order form, there is a line-item for Markup:

Aside from taxes, title, license fees and what not... The price wouldn't change. Those can be quite a lot, on my purchase, they total ~$6K. So, make sure you are aware of them. It's something I actively ignore as there's no getting around it :)

As much as we'd love it to be, the screen shot isn't a legal document, neither is the white order summary that dealers give you. So they can pull whatever dealer tricks they want when the truck is delivered.

All a dealer really needs to do is make it more of a hassle than you are willing to deal with. It eventually comes down to trust.

I think that most dealers are honoring the MSRP of ordered trucks, even ones who like to charge for pin stripes, nitrogen filled tires and other nonsense. It's just the worst of the worst dealers screwing people over with surprise ADMs or just plain selling new trucks out from under the original buyers.

To get a good idea of what your particular dealer does in this situation, go to the dealerships not charging ADMs thread here as well as on the new Bronco forums.

Some dealers will automatically charge $5,000 for some plastic door guards, cheapo alarm system and paint finish they spray on for all their vehicles as part of their "dealer prep".

Pays to visit the dealership before your truck comes in and see how they do business on their lot cars....

I mean if they pull that stunt on an already $79k truck, who is going to play ball on their Market Adjustment Game? I can see $10k on a Pro, but XLT and up?

If the dealer "accepted" that order, then personally, I think that's a legally binding purchase agreement. Paperwork doesn't have to have some chicken scratch of a piece of paper, in order for it to be "accepted".

That being said, if you're concerned, best bet would be to get them to give you a purchase agreement for the car, with delivery date TBC, but your order / reservation number on there. That way you'll both be on the same page, and can make informed decision today instead of showing up to pick up your truck, having sold your current method of transportation, to get into a fight -- whether it be ADM, or some $1000 ceramic coating you didn't want.

In the Bronco world, Ford had guidelines and penalties (losing future allocations) for dealers not selling to the original order holders. The threshold was around 80% match in the beginning, but slipped lower at the end of the year. A dealer can still do the bad thing, but there is tracking and maybe some punishment.

I do think we hear more about the bad dealers with sutpid ADM and fees vs the many that quietly do the right thing. I was in a panic about markups with my dealer, for the bronco and did not have written confirmations of msrp. But it was unfounded, the honored the pricing, did not do any crazy add ons.
