I didn't see this anywhere yet from the forum response contributors, but where was the auto braking that is supposed to happen? Was that turned off? There are notification sounds also when you get too close. And the person that was rear-ended took off? Something doesn't sound right. There has to be more to the story.
This is what I always dread when leaving my vehicle for service or repairs. Someone unnecessarily "testing" its 0-60 performance.

Mine is in the shop now because I was rear ended in a parking lot. Damage $7k. I found the nearest Ford Body Shop, which requires a 2 hour drive one way.

It is still your truck and you can decide where the repairs will be done, paid by their insurance. Have it fixed right.

Ouch. I had a pickup stoled from a dealer lot, so craziness can happen.

I wonder how they will avoid the carfax and diminshed value? Likely just planning on ordering parts and having their body shop fix it with no claim to any insurance?
easy, just what you said. they repair it themselves without making a claim

This is what I always dread when leaving my vehicle for service or repairs. Someone unnecessarily testing" its 0-60 performance.
When I was trading in my first Lightning the dealer took it for a test drive as is typically done but after I reviewed the dashcam footage I saw that they launched multiple times during their “test drive”

Why it's so important to have a dashcam. I have two in mine and recorded a few instances that I brought up to management. Nothing criminal, but the techs need to be held accountable while in a customers vehicle; and they need to know they are being recorded. I did catch a tech trying to test the accelerator pedal in mine. No harm done, but not something I want to see.

It is not for the dealership to decide diminished value or not.

Call your insurance company too, but only after you speak to an attorney.

All states, that I know, have a "lawyer referral service" and for a very small amount an attorney will talk to you about your options.

I used the Virginia service, 20 years ago, and for $20 I found an attorney to handle my Lemon Law issue. Another $120 and he sent a letter that ended with a buy back.

It's business. The dealership will understand 'business.'

Fords EDR data is extensive. It most likely recorded a non deployment event and possibly pre collision data up to 5 seconds before impact. Usually that data is overwritten if there is another non deployment event recorded (deployment events are locked in). In addition, the driver assist technologies now record as well. There is a good change the collision was recorded by the pre crash avoidance camera and stored. The images aren’t great quality but they give you a good idea of what happened. Fords modern EDR data also includes telematics from the infotainment center so GPS location data is also stored.

The tools needed to pull the data are expensive (Bosch CDR). Usually insurance companies contract to private collision investigators. Most dealerships do not have this tool. If you google investigators in your area they may pull the data for you. it likely won’t be cheap especially if you want to avoid using insurance.

I had sort of a similar situation in my model 3, I was getting it inspected at a firestone, and they must have thought I left and would be back later, but I only walked to a nearby apartment development and sat on some steps there to wait. They swung by and did a 0-60 launch right in front of me.

Was your car even moving at the time? It could have been hit while it was in the lot. Any recording possible like a DTC etc?

One time my vehicle was in the dealer shop being repaired it was returned with 25 extra miles. Mental picture from that scene in Ferris Buellers day off, “I’m a professional, man.”
now I put an AirTag in the truck, just to see where it’s been when at the Dealership.

I won’t let a dealer take my car for a test drive because they don’t own it and I don’t want them having possession of my keys to screw with me before we’ve made a signed deal. I go to the manager and say, “I can take you for a test ride in it to show you everything is functioning.” If they try to object, you just say “it’s an insurance thing”

never had a dealer not agree to this and if they did, I’d leave anyways.

now I put an AirTag in the truck, just to see where it’s been when at the Dealership.
FordPass app Maps can show exact position of truck. I could see the move from the shop to the dealer outside lot.
