The best option is not to agree to anything in any contract that you cannot fulfill. With the strong language of that no sale provision, they wouldn't need a shady lawyer to cost you a truckload of money. In fact, they'd probably use a fancy, high-priced downtown lawyer to run up the costs. They'll win the case.

Answer to above hypotheical case: The purchaser is dead.
For hypothetical case and all others, enforcement is at the discretion of the Seller (Dealer) For perspective, this is the answer Ford offered to dealers who wanted to charge ADM as a matter of ordinary business on 'market pricing' customer ordered vehicles. Dealer holds all the cards on purchase pricing, Ford holds all the cards on vehicle allocations. Purchaser wears the shoes to walk away until the final purchase agreement is signed. You may be able to negotiate this into a right of first refusal, it's the Seller writing the contract.
Agree to above. I dont see dealers coming in and enforcing it. However it will cause some owners to sell it back to dealer. That on its own is mission accomplished.

Just picked up. Ended up signing it but gave them hell. Scared a few customers they probably lost in the process. Serves them right. Iā€™m keeping the truck anyway so Iā€™m not terribly worried about it. Frankly it was more of a principal thing more than anything.

agreed, and I really don't think there is any real-world enforcement of a contract that says that YOU can not SELL something that you OWN - no matter WHEN you purchased it. I would like to see any dealer actually follow thru with any 'legal' action as it would cost them more than anything they would get from it, WHATEVER that could be. I'm not sure why a dealer would care, or Ford. I understand they may be trying to waylay any 'scalpers', and they are welcomed to take action if that's the case, but the everyday Joe does not have a worry.

My frustration is, take for instance the seats of the pro. They have marginal / non existent lumbar support. If i drive my truck for the next 3 months and cant stand the seats, and want to sell itā€¦am I not supposed to because I signed this contract and ford made a mediocre seat that i didnt have the chance to test drive fully? Mind you they sell plenty of other vehicles over MSRP every day so this isnt a poor ā€˜woe is meā€™ situation, theyre just being greedy

Since you did sign the agreement, make sure you rate them "appropriately" on the Ford survey you get.

Wow, if I had to sign, I'd tell them I want my attorney to read it before I would sign.

Frankly, I don't think it's enforceable - at least in a judge's view.

I feel bad because the ā€œexperience guideā€ was great and he was freaking out because his compensation was based on my survey and I was furious at the finance guy but I only get one survey. Feels like a shoddy system (unsurprisingly).

All dealership employees work for the dealer owner. If they get bad surveys and compensation takes a hit, they will quit and find new jobs. Dealer owner will change his ways.

Tell him to take his $0 commission up with the finance guy. Maybe the deal desk will have a bleeding heart and give him some money.

Rate those dipshits a negative score if you can.

The language is on some articles directly. They tried to tell me it was a ford thing (itā€™s not) and that they might have to treat every customer the same (also not true). My guy was being a dick but with the pro I knew I wasnā€™t going to be too disappointed. I think you actually run the risk with thinking your $90k platinum isnā€™t worth the cash. Also I donā€™t think I could flip a pro for the crazy money the others go for. Generally people who have so much disposable income are going to waste it on the loaded versions.

Okay, so here's the obvious next question...

Why would this no-resale-within-a-year requirement be a part of some peoples deals and not others?

If it's a Ford mandate then why didn't I have to sign one?

I'm now going to go look through all that paperwork again.....to make sure....
